Dapatan Awal Mengenai Praktis Wakaf Ahli di 5 Buah Majlis Agama Islam Negeri (Main) di Malaysia: Kajian dari Aspek Benefisiari Wakaf

Wakaf Ahli pernah memainkan peranan signifikan dalam pembangunan ummah satu ketika dahulu. Di Malaysia, walaupun praktis Wakaf Ahli tidak begitu popular, namun terdapat rekod yang menunjukkan kewujudan pengamalan Wakaf Ahli dikalangan masyarakat. Namun begitu, praktis Wakaf Ahli dilihat tidak begitu digalakkan atas faktor kesulitan dalam pengurusannya. Oleh itu, kajian ini mencadangkan solusi reka bentuk pelaksanaan Wakaf Ahli dari aspek benefisiari wakaf. Bagi mencapai objektif ini, kajian ini telah menggunakan metodologi analisis dokumen dan temubual terhadap 5 buah MAIN terpilih. Pada fasa pertama, analisis dokumen dilakukan terhadap kitab Fiqh bagi mendapatkan pandangan Fuqaha Muslim terhadap benefisiari Wakaf Ahli. Manakala pada fasa kedua, temubual dilakukan terhadap 5 buah MAIN terpilih iaitu MAIN Kelantan, Pulau Pinang, Terengganu, Perak dan Johor bagi mengetahui praktis semasa Wakaf Ahli di negeri-negeri berkenaan. Data yang diperolehi telah dianalisis secara tematik dan secara perbandingan dengan bantuan perisian Atlasti.8. Hasil kajian mendapati benefisiari Wakaf Ahli perlu ditetapkan sejak awal penciptaannya yang merangkumi limitasi benefisiari keluarga dan benefisiari akhir wakaf.
Waqf Ahli once played a significant role in the development of the civilization.In Malaysia, although the practice of Waqf Ahli is not very popular, however, there are few records that show the practice of Waqf Ahli among the community. However, the practice of Waqf Ahli is seen as not being encouraged due to the difficulty in its management. Therefore, this study proposes a solution from the aspect of waqf beneficiaries. In order to achieve this objective, this study has used the methodology of document analysis and interviews with 5 selected State Islamic Religious Councils (SIRCs). In the first phase, document analysis were made toward the book of Fiqh to obtain the views of Muslim scholars on the beneficiaries of Waqf Ahli. While in the second phase, interviews were conducted with 5 selected SIRCs namely SIRC in Kelantan, Penang, Terengganu, Perak and Johor to identified the current practice of Waqf Ahli in the respective states. The data obtained was analyzed thematically and comparatively with the assist of Atlasti software version. 8. The finding of the study found that the beneficiaries of Waqf Ahli need to be set from the beginning of its creation, which includes the limitations of family beneficiaries and ultimate beneficiaries of waqf.
